Acceptance of Terms
By downloading, accessing, or using CalGPT app ("App", "we", "us", "our"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.
Eligibility
You must be at least 13 years old (or the minimum age in your jurisdiction) to use the App. If you are under the age of majority, you represent that you have parental/guardian consent.
Accounts and Security
- •You may sign in using Google, Sign in with Apple, or email/password.
- •You are responsible for maintaining the confidentiality of your account and for all activities under it.
- •You must provide accurate information and promptly update it as needed.
- •We may suspend or terminate accounts for suspected misuse or violation of these Terms.
Subscriptions and Purchases
Certain features may require a paid subscription. Prices, billing cycles, and renewal terms are shown in-app and may change with prior notice as required by law.
- ✓Trials, promotions, and discounts are subject to additional terms shown in-app.
- ✓Apple's App Store billing terms apply to purchases made through the App Store.
- ✓Manage or cancel via your Apple ID settings before renewal to avoid future charges.
User Content and License
Your Content Rights
You may upload or capture content (e.g., food photos, comments). You retain ownership of your content.
You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, analyze, display, and create derivative works from your content solely to operate, improve, and provide the App's features (including AI-based analysis and thumbnails).
You are responsible for your content. Do not upload anything illegal, infringing, or harmful.
Health Data and HealthKit
- 🏥Health data access (e.g., weight, steps, active energy, workouts, dietary data) is optional and requires your explicit iOS permission.
- 🔒Health data is used only to provide the features you request (e.g., logging, insights) and is not used for advertising.
- ⚙️You can manage or revoke permissions anytime in iOS Settings > Privacy & Security > Health > CalGPT.
AI Features and Accuracy
The App uses AI to analyze meal photos, labels, and descriptions and to provide nutrition estimates, suggestions, or recommendations.
Important Disclaimer
- ⚠️AI outputs may be inaccurate or incomplete and are provided for informational purposes only.
- ⚠️The App does not provide medical, nutritional, or professional advice.
- ⚠️Always consult qualified professionals for health decisions.
Privacy
Our data practices, including categories of data collected (e.g., account info, photos, analytics, push tokens, optional Health data), use purposes, and sharing with service providers, are described in our Privacy Policy.
By using the App, you acknowledge and agree to the Privacy Policy.
You can request account deletion in-app; deletion may require recent sign-in for security.
Third-Party Services
We rely on third-party service providers to operate the App, including but not limited to:
Authentication & Storage
- • Authentication and data storage services
- • Third-party sign-in providers (Google Sign-In and Sign in with Apple)
Analytics & Health
- • Analytics services (product improvement; no advertising)
- • Apple Health (HealthKit)
AI Processing
Secure cloud computing services for AI analysis and related processing
Your use of third-party sign-in is subject to those providers' terms. We are not responsible for third-party websites or services.
Acceptable Use
You agree not to:
- ✗Violate any law, contract, or third-party right.
- ✗Upload unlawful, infringing, defamatory, or harmful content.
- ✗Interfere with or disrupt the App, bypass security, or reverse engineer components.
- ✗Use the App to develop competing datasets or models or to perform automated scraping without permission.
Intellectual Property
The App, including software, design, and content we provide, is owned by us or our licensors and protected by intellectual property laws. Except for rights expressly granted, no license or ownership is transferred to you.
Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $50.
Indemnification
You agree to indemnify and hold us harmless from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the App; (b) your content; (c) your violation of these Terms or applicable law.
Termination
We may suspend or terminate your access at any time for any reason, including violations of these Terms. Upon termination, your right to use the App ceases. Sections that by their nature should survive termination (e.g., IP, disclaimers, limitations) will survive.
Changes to the App or Terms
We may update the App and these Terms from time to time. If changes are material, we will provide notice as required by law. Continued use after changes means you accept the updated Terms.
Governing Law & Venue
These Terms are governed by the laws of Delaware, United States, without regard to its conflict of law rules. You agree to the exclusive jurisdiction and venue of the courts located in Delaware, except where prohibited by law.

App Store Terms
If you downloaded the App from the Apple App Store, you also agree to Apple's applicable terms. Apple is not responsible for support or warranty beyond what is required by law.
Miscellaneous
If any provision is found unenforceable, it will be modified to the minimum extent necessary, and the remainder will remain in full force. Failure to enforce a right is not a waiver. You may not assign these Terms without our prior written consent.
